## *Who is liable when autonomous AI causes harm?*

*When an [autonomous AI system](https://www.nexsynaptic.com/blog/ai-agents-regulation) causes harm, liability may fall on the provider (developer) and/or the deployer (the enterprise using the system), depending on their respective roles in developing, implementing, and overseeing the system. Under the revised Product Liability Directive (PLD, Directive (EU) 2024/2853), software and AI systems can qualify as “products,” meaning that a manufacturer may be liable for harm caused by a product defect regardless of fault. [The EU AI Act](https://www.nexsynaptic.com/blog/eu-ai-act-risk) additionally imposes obligations relating to oversight, documentation, and risk management, particularly for high-risk AI systems.*

*[EUR-Lex](https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX:32024L2853) , [European Commission.](https://digital-strategy.ec.europa.eu/en/policies/regulatory-framework-ai)*

<https://www.nexsynaptic.com/blog/eu-ai-act-risk>

## *Deployer Liability Under the AI Act*

*While the revised Product Liability Directive (PLD) primarily targets manufacturers and developers, **the EU AI Act shifts part of the burden onto "deployers"**—the enterprises or entities using AI systems in their professional activities.*

*[If an autonomous system causes harm,](https://www.nexsynaptic.com/blog/is-ai-less-dangerous-than-si) the deployer may be held directly liable if they neglected their statutory obligations, which include:*

- ***Human Oversight**: Deployers must ensure that qualified individuals actively monitor the operation of high-risk AI systems and, when necessary, intervene or shut the system down. If harm occurs because human oversight was merely nominal ("on paper"), the deployer can be held liable.*
- ***Compliance with Instructions**: If a deployer utilizes an AI system outside its intended purpose or contrary to the manufacturer’s technical instructions, the liability for any resulting harm shifts to them.*
- ***Control Over Input Data:** For systems that rely on data provided by the user, the deployer is required to ensure that such input data is relevant and representative.*

*In practice, if an autonomous AI system in a hospital or bank makes a faulty decision and causes harm, the injured party will often sue both the provider (for a product defect) and the deployer (for negligent oversight or management).*

*The ultimate outcome will depend on whether the failure originated in the source code itself (the product) or in the manner it was managed in operation.*

*The updated European civil liability framework establishes strict rules for the creators of that software.*

## *The New Legal Framework: Software as a Product*

*The revised PLD and the EU AI Act together change the environment in which AI systems are developed and deployed. This does not mean that every piece of software is automatically a “dangerous product” or that every incorrect AI output automatically creates developer liability; a defect, damage, and a causal link must always be established.*

### *<https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX:32024L2853>Liability Without Proof of Fault*

*The PLD introduces manufacturer liability for product defects regardless of fault. The injured party therefore does not need to prove the manufacturer’s negligence, but must still prove:*

*that the product is defective;*

*that they suffered damage;*

*that there is a causal link between the defect and the damage.*

*Software, including AI systems, is expressly covered by the definition of a product. A manufacturer may also be liable for defects arising after updates or upgrades under its control and, in certain circumstances, for changes caused by an AI system’s continuous learning while it remains under that control.*

### *Burden of Proof: Easier, but Not an Automatic Presumption*

*The claim that a court automatically presumes a defect whenever a development team fails to keep detailed logs is an exaggeration. The PLD makes it easier for injured parties to prove their case, but conditionally:*

- *A defect may be presumed if the defendant fails to disclose relevant evidence it is required to disclose, if the product does not comply with mandatory safety requirements, or in cases of obvious malfunction in reasonably foreseeable use.*
- *A causal link may be presumed where a defect has been established and the damage is of a kind typically consistent with that defect.*
- *A court may presume a defect, causation, or both where the injured party faces excessive difficulties in proving its case due to the technical or scientific complexity of the product.*

*Therefore, inadequate logging, documentation, and transparency can seriously weaken a provider’s defense, but they do not automatically become an irrefutable presumption that the software caused the harm.*

### *Human Oversight: An Obligation for High-Risk Systems*

*The EU AI Act does not require [human oversight](https://www.nexsynaptic.com/blog/eu-ai-act-2026) for all AI applications, but for high-risk AI systems. The provider must ensure appropriate human-oversight measures, while the deployer must assign oversight to competent, trained, and authorized individuals and provide them with the necessary support.*

*<https://digital-strategy.ec.europa.eu/en/policies/regulatory-framework-ai>Deployers of high-risk systems must use the system in accordance with its instructions, ensure human oversight, monitor its operation, manage input data, retain logs for at least six months, and report risks and incidents. [AI Act Service Desk.](https://ai-act-service-desk.ec.europa.eu/en/ai-act/article-26)*

*The obligations for high-risk AI systems are not immediately fully applicable. According to available information on later adjustments to implementation, they are expected to apply from 2 December 2027 for stand-alone high-risk systems listed in Annex III, and from 2 August 2028 for AI systems embedded in products listed in Annex I.*

| Risk | High - Risk AI /autonomous agents | Standard SaaS/ deterministic software |
| --- | --- | --- |
| Legal regime | AI Act for high-risk systems + PLD for product defects | AI Act for high-risk systems + PLD for product defects |
| Main obligations | Risk management, documentation, logging, high-quality data, human oversight, post-market monitoring | Security, privacy, QA, maintenance, and contractual risk allocation |
| Compliance cost | Potentially significantly higher, but depends on criticality and autonomy | Lower but not negligible |
| Insurance | May require specialized professional and product-liability coverage | More standard coverage, depending on contract and risk |

## *Risk Mitigation: Three Pillars of Enterprise AI Architecture*

### *Strategic Indemnity Management*

*Customers increasingly demand clear provisions on liability, warranties, and indemnification for AI-system errors. Development teams can contractually limit liability, for example to 12 months of contract value, but this is not mandated by EU law and must comply with mandatory law, rules on unfair contract terms, and non-waivable liability for harm caused by a product defect.*

 *Key measures include:*

- *A clear definition of intended use and prohibited scenarios.*
- *Customer obligations regarding configuration, input-data quality, oversight, and employee training.*
- *A clear allocation of responsibility for integration, access data, and human approval of decisions.*
- *Carefully drafted limitations of warranties and liability.*

### *Logging and Evidentiary Architecture*

*Logging is not merely an additional compliance feature; it is evidentiary infrastructure. For high-risk AI systems, the EU AI Act requires activity logging to track outcomes, while deployers must retain logs for at least six months.*

*<https://ai-act-service-desk.ec.europa.eu/en/ai-act/article-26> However, it is not accurate to say that the data burden can simply be shifted to the customer’s infrastructure. The provider may still have obligations regarding technical documentation, post-market monitoring, and cooperation with competent authorities.  A practical architecture should include:*

- *Versioning of models, prompts, rules, configurations, and data.*
- *Records of inputs, outputs, escalations, and human interventions.*
- *Integrity controls for logs and restricted access.*
- *A clear division between data retained by the provider and data retained by the deployer.*

*No LLM or [autonomous agent](https://www.nexsynaptic.com/blog/eu-ai-act-autonomous-ai-agents) can guarantee absolute predictability.*

*Architecture must therefore impose hard limits at the API, workflow, and permission levels: transaction limits, action whitelists, approval requirements for high-value transactions, escalation on uncertainty, stop-loss mechanisms, and an immediate kill switch.*

### *Cybersecurity as a Source of AI Liability*

*A significant number of AI-related harms may arise from security and operational failures, such as:*

- *prompt injection attacks,*
- *data poisoning,*
- *model exfiltration,*
- *compromised APIs,*
- *inadequate management of identities, permissions, and access rights.*

*In practice, many incidents involving artificial intelligence will prove to be a combination of [cybersecurity](https://www.nexsynaptic.com/blog/ai-security) and AI-related issues. A system may produce a harmful outcome because it has been exposed to malicious instructions, compromised input data, manipulated external services, or unauthorized access.*

*For that reason, AI risk management cannot be limited solely to model accuracy and regulatory compliance. Cybersecurity, access control, input-data validation, the security of integrations with external systems, and continuous monitoring and anomaly detection are equally important. Organizations deploying autonomous AI systems should view AI governance and cybersecurity as a unified risk-management framework rather than as separate disciplines.*

***AI software development does not necessarily become unprofitable, but for high-risk and autonomous systems it becomes a discipline in which safety, documentation, oversight, and legal architecture are part of the product itself. Profitability will depend more on the ability to offer a verifiable, controlled, and contractually clearly bounded AI service than on attempting to avoid liability altogether.***

## *FAQ*
